New Patents, Utility Models, Integrated Circuits and Layouts Law Issued in Syria

DAMASCUS - Syrian President Bashar Al-Assad issued on March 30, 2012 the Law No. 18 /2012 concerning patents, utility models, integrated circuits and layouts which will be implemented by the Ministry of Industry and Trade. 

A press release by Abu-Ghazaleh Intellectual Property (AGIP) stated that the 86-article Law includes definition of patent and utility model, procedures, penalties and general provisions.

The Law comes in response of the economic changes on local and international levels and a mechanism to provide the appropriate legislation environment that encourages investments, commercial exchange, technology transfer and mobilizing creativity and innovation.

According to the new law, the patent protection period is 20 years instead of 15 years starting from the date of filing the application at the Syrian Patent Office.

In line with the new law a substantive examination will be conducted of the applications prior to the publication stage. All applications that fail to meet the provisions of this law and its Implementing Regulations shall lapse.

The new law will come into force 60 days after its issuance, and its Implementing Regulations and relative fees will be issued within 45 days.

It is worth noting that the original version of the law is now available in Arabic and posted on AGIP's website www.agip.com while the English translation will be posted soon.
