Opportunity Ripe to Advance Data Breach Bill, BSA Says

WASHINGTON, DC - The Business Software Alliance (BSA) announced in a press release that it has renewed its strong support for national data security and breach notification legislation as the House Energy and Commerce Subcommittee on Commerce, Manufacturing and Trade was scheduled to markup Chairman Mary Bono Mack’s SAFE Data Act (H.R. 2577). 

“A series of high-profile breaches has shaken public confidence in data security practices. For the good of the digital economy, we need national legislation that restores trust by requiring organizations to implement reasonable security procedures and notify people when a breach puts them at risk,” said BSA President and CEO Robert Holleyman, who voiced support for data breach legislation in June testimony before the Subcommittee. 

“The framework that Chairman Bono Mack proposes is fundamentally sound,” Holleyman said. “It requires organizations that hold sensitive personal information to implement reasonable security procedures. It creates market incentives to adopt strong security measures. It ensures that consumers will be notified when a breach puts them at risk of identity theft, fraud or other unlawful activity. By creating a uniform, national framework that preserves an enforcement role for state authorities, it also streamlines compliance burdens. The net effect will be good for businesses and consumers alike.” 

“The latest iteration of the SAFE Data Act includes some noteworthy improvements in the area of preventative security,” said Holleyman. “BSA looks forward to working with Members as the legislative process continues to unfold.”
